In the operation of any charitable giveaway, raffle, or promotional event, innumerable potential scenarios may arise in which Heritage Ministries operating under Homestead Fair (hereafter “the Sponsor”) would not and should not be held liable, since participants voluntarily assume the risk of engaging in a public activity subject to factors beyond organizational control; for example, the Sponsor would not be liable if a participant experiences a mechanical failure, accident, or injury while operating, transporting, or maintaining a prize vehicle, tool, or piece of equipment after transfer of ownership, because once possession passes, all risk of loss shifts to the recipient; likewise, no liability would attach for incidental expenses such as fuel, registration, insurance premiums, or repair costs, nor for consequential losses like business interruption or loss of use; the Sponsor would not be liable if weather conditions—heat, cold, lightning, flood, or tornado—cause cancellation, postponement, or discomfort during the event, as such occurrences constitute force majeure beyond human foresight or control; similarly, if a government agency imposes restrictions, quarantines, or curfews that require modification of event format, the Sponsor is excused from performance and bears no responsibility for inconvenience, travel cost, or expectation damages; if data systems fail, servers crash, internet connectivity is lost, or payment processors experience outages resulting in delayed or missing entries, the Sponsor is not liable because such technical interruptions are inherent in electronic communication networks not owned or maintained by the Sponsor; if participants submit incorrect or illegible contact information, resulting in the inability to notify a winner, the Sponsor bears no duty to locate or re-award a forfeited prize; if third-party platforms such as Facebook, Instagram, or Etix alter their algorithms, remove posts, suspend accounts, or otherwise interfere with digital visibility, those actions fall outside the Sponsor’s control and generate no compensable claim; if participants incur mobile data charges, roaming fees, or credit-card processing costs while entering, such charges are the sole responsibility of the user; if a shipping carrier misdelivers, delays, or damages a mailed prize, the Sponsor is not liable for replacement once the item leaves its custody; likewise, no liability arises if customs, import duties, or postal errors occur for winners outside the United States; if a participant experiences emotional distress, disappointment, or loss of perceived opportunity because they did not win, such subjective reactions do not constitute compensable injury; if another entrant posts defamatory, harassing, or misleading material on social media in connection with the giveaway, the Sponsor is not responsible for moderating independent speech except where legally compelled; should counterfeit tickets, duplicated QR codes, or unauthorized resale of entries occur, the Sponsor is entitled to void those entries without compensation, since fraud and tampering negate participation rights; if a volunteer misstates information verbally or via email contrary to the official written rules, the written terms govern and the Sponsor bears no responsibility for reliance on unofficial communications; the Sponsor is likewise not liable for errors in translation, typographical mistakes, or formatting inconsistencies in printed materials, as participants are presumed to understand the controlling version published on the Sponsor’s primary website; if the prize includes perishable goods, live plants, or consumable items that spoil, trigger allergies, or cause illness due to mishandling after distribution, liability rests solely with the recipient; if electrical outages, microphone failures, or computer malfunctions disrupt live drawings, the Sponsor may postpone or re-conduct the selection without incurring penalties; if third-party donors withdraw pledged prizes or substitute items of different color, trim, or model year, the Sponsor may issue replacements of equal or greater retail value without further obligation; the Sponsor is not liable for acts or omissions of independent contractors such as tent vendors, food suppliers, or amusement operators providing ancillary services at the fairgrounds; similarly, parking areas are used at the participant’s own risk, and the Sponsor assumes no duty to guard against theft, vandalism, collision, or damage caused by other motorists; if livestock, insects, or environmental allergens cause discomfort or injury, the Sponsor is not responsible, as such risks are inherent to outdoor rural venues; if photography, video, or live-stream coverage inadvertently captures a participant’s image, that incidental appearance does not give rise to privacy or publicity claims; if minors participate under parental supervision, the parent or guardian assumes full responsibility for the minor’s conduct and safety; if disputes arise among entrants regarding ticket ownership, payment division, or shared entries, the Sponsor shall not mediate or adjudicate those disputes; if a winner sells, transfers, or gifts the prize to another person who later suffers harm, the Sponsor remains discharged from any chain of liability following transfer; if state or federal law later changes to restrict raffles, sweepstakes, or donation incentives, the Sponsor is not liable for retroactive compliance burdens or participant dissatisfaction; if a participant relies on a misinterpretation of tax law regarding deductibility or reporting of winnings, that misunderstanding does not impose liability on the Sponsor, who makes no tax representations; if an entrant submits payment through fraudulent or stolen instruments, or through accounts later subject to chargeback, the entry may be voided without restitution; if social-media content related to the giveaway is removed, shadow-banned, or hidden by platform moderation policies, the Sponsor bears no duty to compensate for perceived loss of exposure; if a participant’s computer becomes infected by malware or spyware while accessing third-party portals, that risk lies with the user’s cybersecurity practices; if a catastrophic event—earthquake, fire, explosion, riot, war, or pandemic—renders performance impossible or unsafe, the Sponsor may cancel without liability; if governing authorities close roads, restrict crowd size, or impose evacuation, the Sponsor is excused; if a participant’s employer or institution disciplines them for engaging in the giveaway during work hours or using company resources, the Sponsor bears no connection to that disciplinary action; if entrants misplace receipts, stubs, or confirmation emails, or delete messages identifying winning status, responsibility rests with the entrant to maintain their own records; if legal disputes occur between co-owners of a prize, such as jointly purchased tickets, the Sponsor shall release the prize to any one person whose name appears on the winning record and shall not arbitrate ownership beyond that; if counterfeit promotional material is created by third parties misusing the Sponsor’s name or logo, the Sponsor is not responsible for resulting confusion or loss, though it may pursue its own remedies against the infringer; if technical anomalies cause random-number generators or selection algorithms to malfunction, the Sponsor.

  1. DEFINITIONS AND CONSTRUCTION

    1.1 The singular includes the plural and vice versa. References to “including” mean “including but not limited to.”

    1.2 The word “shall” denotes a binding intention within this illustrative text, though such wording is non-binding.


Rules & Regulations:

All state, federal, and local regulations and laws apply. Void where prohibited by law. Sweepstakes are only open to United States residents.

Prize Provider(s) may thank participants with a discount or offer following the sweepstakes.

Winner must be 18 years or older and reside in a locality where participation is legal.

Each $50 donation through Etix earns one entry into the Homestead Fair Raffle. No purchase, payment, or contribution is necessary to enter or win. Contributing will not improve chances of winning.

For fixed-ticket sweepstakes, completing the Alternative Entry Form is counted as one entry. One Alternative Entry Form entry per household per day is permitted.

No automated, bulk, or third-party entries. No cash equivalents. No substitutions. No transfers. No refunds. Sponsoring Organization and Etix reserve the right to disqualify contestants. Sponsoring Organization and Etix reserve the right to substitute any prize with another prize of equal or greater value. Sponsoring Organization and Etix reserve the right to cancel, suspend, or modify a promotion if any problem prevents the promotion from running as planned. Campaign begins at Start Date and ends at End Date. At the end of the campaign, a winner will be chosen at random.


Selection Process:

All entries receive a number. At the end of the sweepstakes, the total number of entries are automatically tallied and a random number will be selected through a random number generator. Number will be between 1 and the total number of entries. Whichever person correlates to the selected number is the winner.

If you would like to see a list of the winner(s), please mail a self-addressed, stamped envelope to the Sponsoring Organization. Residents of ID, VT, and WA may omit return postage.


How to Enter:

Individuals may obtain eligibility for participation either through qualifying donations or, without the requirement of any such donation, by submitting a written request for one (1) complimentary entry via postal mail to the Sponsoring Organization’s principal address. Said request must include the entrant’s full legal name and contact information and shall be deemed valid only if received within the entry period. Each household is limited to one mailed request per day. Employees, agents, representatives, and immediate family members of the Sponsoring Organization, Prize Provider(s), and Etix are ineligible to participate.

To keep things fair, this sweepstakes is closed to the employees, agencies, and representatives of the Sponsoring Organization, Prize Provider(s).
